Terms of Trade.

These terms apply to every quote, order and supply of goods or services by B&M Plastics Pty Ltd (ABN 66 219 251 305) ("B&M", "we", "us") to a customer ("you"). By accepting a quote or placing an order with us, you agree to these terms.

1. Quotes

Quotes are issued on the basis of the information provided to us and are valid for 30 days unless otherwise stated. We reserve the right to revise a quote where the information you provide changes, where market material costs shift materially before order confirmation, or where additional work is required that wasn't reasonably knowable from the original brief.

Indicative prices generated by our online cut-to-size calculator are starting estimates only. A confirmed quote is issued in writing within 24 business hours of your enquiry.

2. Orders

Orders are deemed accepted when we provide written confirmation. Once accepted, cancellation or material changes may incur charges for work already performed and materials already cut, ordered or committed.

3. Materials and tolerances

Unless specified in writing, materials are supplied to standard commercial-grade tolerances. Where you require a particular grade, certification, fire-rating or food-grade compliance, you must specify this in writing at the time of quote and we'll quote on that basis.

Plastics are subject to natural variation in colour, transparency, shrinkage and surface finish between batches. Where consistency between batches is critical, please tell us at quote stage.

4. Drawings, files and intellectual property

You warrant that any drawings, files or designs you supply do not infringe the intellectual property rights of any third party. You retain ownership of your supplied designs. We retain ownership of any tooling, jigs or production files we develop unless transfer is separately agreed in writing.

5. Delivery

Delivery dates are estimates given in good faith and are not guaranteed unless agreed in writing as a fixed-date supply. Risk in goods passes to you upon delivery to your nominated address or to the freight carrier, whichever is earlier.

Freight charges are additional unless quoted as inclusive. Delivery to remote or restricted-access locations may incur additional cost, please flag at quote stage.

6. Payment

Unless agreed credit terms are in place, full payment is due before despatch. Standard credit accounts are settled within 30 days of invoice. Overdue accounts may incur interest at 1.5% per month and will be referred to debt recovery, with all reasonable recovery costs payable by the customer.

We retain title to all goods supplied until full payment is received. You agree we may register a security interest under the Personal Property Securities Act 2009 (Cth) to protect this retention of title.

7. Warranty

We warrant that goods will be supplied free from material manufacturing defect and to the specifications agreed in the quote. Any claim for defect must be made within 14 days of delivery and the goods made available for inspection. Our liability is limited to repair, replacement or refund at our option.

Nothing in these terms excludes or limits any guarantee, condition or right that cannot be excluded or limited under the Australian Consumer Law.

8. Limitation of liability

To the maximum extent permitted by law, our liability arising from any quote, order or supply is limited to the price paid by you for the goods or services giving rise to the claim. We are not liable for indirect, consequential or incidental losses, including loss of profit, loss of business or loss of reputation.

9. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disaster, government action, supply disruption, industrial action or pandemic.

10. Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute will be heard in the courts of New South Wales.
